Election Of The Employees’ Members Of The Supervisory Board : Germany

All employees’ members of the supervisory board, i.e. those working in the company and the trade union representatives, are elected by direct ballot or by delegates. In companies with up to 8,000 employees, the law prescribes a ballot, but employees may, by a majority vote, opt to be represented by delegates. In the case of companies with a work force of more than 8,000, the law prescribes elections through delegates. The employees may, however, reverse this procedure; in other words, they can choose by a majority vote to have a direct ballot.
